Can an effectively USED car be sold as new if the sale was reversed?
Long story short, I bought a new car after being told it had many features it did not have. Over the course of 1 month and 500 miles of driving, I discovered I had been lied to – and the car also began to have transmission issues (unrelated to the seemingly poor sales practices).
They encouraged me to “trade-in” my NEW vehicle for a very reduced price and tried to bait and switch me from my new car into a used car with more of the equipment that was SUPPOSED to be in the car I had already purchased. I said no deal, of course, and eventually the dealership refunded every cent I had paid for fees and everything (which despite their claims to the contrary, says to me that they were up to something no good).
My question is, does the reversal of sale give them the right to sell an effectively used vehicle (I had it for over a month and put more than 500 miles on it) as a new one?
They have it listed on their website as new right now, for the same sticker and dealer discounted price as when it was actually new. Also, before anyone asks, I know it i the same car because the VIN matches.
If this isn’t ok for them to do, does anyone know who I would contact to flag this dealership? They were very crooked and I feel bad for the next person who gets suckered by their unethical practices.
Also, I should add … the sale was reversed, so although I had already received plates, I was still waiting on title … and the title was stopped before issue and reversed …
I think I will contact the BBB though, they could probably tell me. I would like to save someone else the stress and aggravation (if I wasn’t so hardnosed and stubborn I would have never gotten my cash back for the hunk of junk).

The car can be resold as new – if and only if the car was never titled. Once the car receives a title the dealer no longer has the Manufacturer’s Statement of Origin (MSO). A titled car is always a used car. A car sold with the MSO is a new car, and can be sold as a demonstrator, program car, or company car. The miles on the car make no difference. I worked for a dealer that gave us demos as incentive. If we sold x number of new cars in one month, the next month we could drive a new car with a dealer tag. Those cars often had 4000 miles when sold as a new car. State laws may vary, but the state I was in at the time did not require us to disclose ‘unwound’ deals.

Dealer intentionally posted wrong price …?
I was searching online for a new car and I came across a nice newer car for super cheap which I assumed to be a mistake, but called anyway. When talking to them on the phone they informed me that they knew it was like that and told me the actual price of the car (WAY higher than listed!). A week later the price is still the same, the same car, same vin #, same dealer, on different websites!!! Can they do that? Or if I have the pages printed out and I walk into that dealership do they legally have to sell me the car for that price. They KNOW that they did this, and for whatever reason are intentionally leaving it like that. I want the car!!! Don’t they have to give it to me for that price by law? Or isn’t it false advertising? Please help! Thank you!
I know that’s how they lure customers, but I am a retail manager and when something is wrongly priced we have to give it to the customer at the cheaper price… shouldn’t it be the same? Isn’t what they are doing ILLEGAL?

Yes it is illegal. They had sufficient time to have the “error” corrected. I would report them to the agency that they get their business license from. I would also contact the attorney generals office for your state.

Car Dealership wants their car back after their store burnt down (this is long)?
So back in September my BF went and bought a used car from a dealership here in Texas. Then about two weeks ago they called us up and said “hey, we want to buy that old car back and we will give you 120% of it’s blue book value.” We asked them why they wanted the car back and they said that their inventory of used cars was getting low. So we go up there and they put the 120% of the blue book value of the old car towards the purchase price of the new car and give us a $5000 rebate on the new one as well. So we sign all the paper work give our old car back and drive off happy campers.
Saturday night the dealership burnt down and they lost all of their paper work on everything. So they call us back today and say hey we need you to bring the car back TONIGHT so we can verify the VIN numbers on the car. Well my BF was working so I gather up my two babies and go over there so they can do that. Well they asked for the keys so they could go and check the VIN and when the finance guy comes back he says “well we need to take our car back because the financing didn’t go through” So after long discussions on everything they said we had to take our old car back unless my BF could get a co-signer. The problem is that his dad was the co-signer for the used car we got from them the first time and they used him for this loan as well and now he suddenly isn’t approved. They didn’t have any paper work to show me and didn’t have any paper work for me to sign to take the old car back. Then they gave me the car back and it had no licence plates and no gas. So I told them I couldn’t drive it. They gave me temporary tags but the finance guy said he couldn’t give me any gas because “they were closed now” I had just filled up the gas tank in the new car before I got to the dealership and didn’t have any money. I told the guy that and he said “well I don’t know what to tell you” and walked off. I told him I was going to have to walk home (it’s cold and dark) and I have a newborn and a two year old daughter. And he ignored me. So I gathered my kids and started walking home. I don’t live too far away from the dealership but still. It was far enough for me and my kids to freeze our butts off. The finance guy locked up the dealership and drove off, passing me by as I walked down the street. I am so furious and I have no idea what’s going on. Everything with this deal seems shady. I’m so angry but I don’t even know how to handle this situation.
Any suggestions? I’m sorry this is so long.
we don’t have any paper work showing anything because they said they would mail it to us. All we have is a receipt for the title transfer for the temporary tags and registration. It just seems shady that they didn’t give us any papers and then the place burned down. Makes me wonder how many other people this happened to.
AND we already got car insurance on the damn car.

Prosecute them to the fullest possible extent of the law. This is known as “Insurance Fraud” and they’re trying to get all possible money from everywhere possible, from insurance to the customers, so you’re getting screwed.
Once you signed the papers to the car with the title and everything in your name, the car is legally yours, so technically speaking, you definitely need to get that car back ASAP and also press charges against them alongside with reporting them to insurance fraud.
Take that company to the cleaners.
